3. The Pre- Owned Vehicle (“Vehicle”) displayed herein are sold on "As is where is" basis. For date and terms of delivery, the Customers are advised to contact the respective dealer.
4. All or any sales through this website are effected by Authorized Dealers of Mercedes-Benz India Private Limited (“Dealer”). Hence, the sales transaction will be a contract between the customer and the respective Dealer solely, and Mercedes-Benz India Private Limited (MB India) and CarTrade Tech Limited (CarTrade) is not privy to such an agreement including the commercial terms and other terms agreed between the Dealer and the customer as Dealer acts in its independent capacity in this business. MB India and CarTrade will not be liable for any direct or indirect loss or damage of whatsoever nature caused to the customer under any purchase through this website. Further, MB India and CarTrade will not be responsible for the contents of the website that are maintained on the bases of details received from Dealer and approved by Dealer and therefore waives its liability for any links from this website to other websites.
5. The Vehicle images are as posted by the respective Dealer. The Vehicle images are for representation purpose only and are subject to variation in color, appearance due to photographic effects, lighting conditions etc. at the time of taking the image.
6. The customer shall inspect the Vehicle thoroughly and satisfy himself/ herself about the condition of the Vehicle before concluding the purchase formalities. No claim of whatsoever nature concerning Vehicle performance or Vehicle quality except inherent warrantable defects (provided the Vehicle is under warranty) shall be entertained by the Dealer after the Vehicle is sold.
7. The prices specified herein are indicative and may not be final. The indicated price may differ due to purchase of any additional accessories, parts or products, services that may be availed by the customer, discounts that may be offered by the respective Dealer, change in government taxes, duties, fees or levies, change of state of registration etc. The Dealer shall not be responsible or liable to compensate for the difference in the prices due to aforesaid reasons or any reason beyond the control of the Dealer.
8. If the posted price (including finance and lease payments) for a Vehicle is incorrect, the Dealer will endeavor to provide Customer with correct prices as soon as we become aware of the error. In the event a Vehicle is priced incorrectly, Dealer shall have the right to refuse or cancel any orders placed for the Vehicle presented with the incorrect price.
9. Any taxes/ charges incurred in carrying out the sale transaction shall be borne by the customer, as applicable at the time of sale. In case, GST is applicable at the time of delivery/ payment/ invoicing of the Vehicle, the taxes shall be levied according to the provisions as contained in the GST Laws. The taxes as per applicable laws shall be borne by the customer.
10. The booking may be cancelled by the customer within 7 days by writing to Dealer and the refund shall be processed by the Dealer within 7 working days from the date of cancellation.
11. The Dealer reserves the right not to accept the booking or cancel the booking without providing any reason whatsoever for the same to the customer. However, in such cases, the Dealer shall process the refund of the booking amount within seven days from the date of cancellation. Booking of Used Vehicle is non-transferable or non-assignable, except in case of any unfortunate event to the Customer, subject to providing valid documents of nominee / legal representative.
12. Delivery of the Vehicle by the Dealer shall only be made against 100% payment and completion of all necessary formalities to the satisfaction of the Dealer. The sale and delivery of Vehicle shall be subject to fulfillment of all applicable statutory obligations and submission of requisite supporting documents. The Customer shall produce the originals of the requisite documents for RTO registration etc. at the Dealership. In the event of the customer’s failure to ensure compliance of these requirements, the booking amount paid by the customer may be forfeited by the Dealer.
13. Mercedes-Benz Group AG always protects their Intellectual Property, including their patents, trademarks and copyrights. Accordingly, you are at this moment on notice that neither this Internet site nor any material contained therein (which is subject matter of intellectual property) shall in any way grant or be taken to grant any person a license to Mercedes-Benz Group AG's Intellectual Property and shall not be copied for commercial use or distribution, nor shall be modified or reposted to other sites. The Website may contain images whose copyrights/TM are attributable to third parties.
14. Unless otherwise indicated, all marks belonging to Mercedes-Benz Group AG and displayed on the site are subject to the trademark rights of Mercedes-Benz Group AG; this applies also to its model nameplates and its corporate logos and emblems.
